1. Acceptance of Terms

By accessing or using Noctambule ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Noctambule is an open-source platform that provides long-term memory, tool integration, and autonomous capabilities for AI agents. The Service is available as a hosted offering or for self-hosting.

3. Account Registration

To use the hosted Service, you must create an account with a valid email address. You are responsible for:

  • Maintaining the confidentiality of your account credentials and API keys
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorized access

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Store or transmit malicious code, malware, or harmful content
  • Attempt to gain unauthorized access to other users' data or accounts
  • Interfere with or disrupt the integrity or performance of the Service
  • Use the Service for spam, phishing, or other abusive activities
  • Exceed reasonable usage limits that impact other users

5. Your Data

You retain ownership of all data you store in Noctambule, including memories, conversations, credentials, and agent configurations. We do not claim any intellectual property rights over your content.

You grant us a limited license to store, process, and transmit your data solely for the purpose of providing the Service.

You are responsible for ensuring you have the right to store any data you upload, including third-party API keys and credentials.

6. Third-Party Integrations

The Service allows you to connect third-party services (GitHub, Slack, Google, Notion, OpenAI, Anthropic). When you enable an integration:

  • You authorize us to access those services on your behalf
  • You are responsible for complying with each third-party's terms of service
  • We are not responsible for any actions taken by your AI agents through these integrations

7. AI Agent Actions

Noctambule enables AI agents to perform autonomous actions (sending emails, creating pull requests, posting messages, etc.). You are solely responsible for:

  • Configuring appropriate permissions and safeguards for your agents
  • Reviewing and monitoring your agents' actions
  • Any consequences of actions taken by your agents through connected services

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may perform maintenance, updates, or experience downtime. We will make reasonable efforts to notify users of planned maintenance in advance.

9. Limitation of Liability

To the extent permitted by applicable law, Noctambule and its maintainers shall not be liable for indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to loss of data, revenue, or business opportunities.

Nothing in these Terms excludes or limits liability for:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation
  • Gross negligence or wilful misconduct (faute lourde ou dolosive)
  • Any liability that cannot be excluded or limited under applicable EU or French law

10. Open Source

Noctambule's source code is available under the MIT License. These Terms apply specifically to the hosted service at noctambule.pierregallet.com. Self-hosted instances are governed solely by the MIT License.

11. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time. Upon termination, your data will be permanently deleted within 30 days.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms. We will notify users of significant changes via email.

13. Right of Withdrawal

If you are a consumer within the European Union, you have the right to withdraw from the Service within 14 days of creating your account, without giving any reason. To exercise this right, contact us at [email protected].

By using the Service before the withdrawal period expires, you acknowledge that you may lose the right of withdrawal once the Service has been fully performed.

14. Dispute Resolution

In the event of a dispute, you may contact us at [email protected] to seek an amicable resolution.

In accordance with Articles L.611-1 and R.612-1 of the French Consumer Code, you may also refer the matter to a consumer mediator. You can access the European Commission's Online Dispute Resolution platform at: https://ec.europa.eu/consumers/odr

15. Governing Law

These Terms are governed by the laws of France. Any disputes that cannot be resolved amicably or through mediation shall be submitted to the competent courts of Paris, France, without prejudice to any mandatory consumer protection rules of your country of residence.
